Payroll Compliance Checklist for Australian Small Businesses

Super, STP, PAYG withholding and Award obligations - everything you need to pay your staff correctly and stay on the right side of the ATO.

Payroll is one of those areas where small mistakes become expensive problems quickly. Getting super wrong, missing an STP lodgement or underpaying an employee under a Modern Award can all lead to ATO penalties or Fair Work complaints. Our payroll service handles all of this for you, but this checklist will help you understand what is involved and what to stay on top of.

Key Numbers

What You Need to Know Right Now

These are the current rates and thresholds every employer in Australia needs to have in their head.

Super Guarantee Rate
12%
Current rate from 1 July 2025. Applies to all eligible employees.
Payday Super Starts
1 Jul 2026

Important change coming 1 July 2026: Payday Super legislation has passed. From 1 July 2026, super must be paid on every payday and received by the employee's fund within 7 business days. The current quarterly system ends. The ATO Small Business Superannuation Clearing House also closes on 1 July 2026 - if you currently use it, you need to move to an alternative before then. Xero Payroll supports Payday Super. Contact us if you need help preparing.

Step-by-Step

Your Payroll Compliance Checklist

Click each section to expand. Work through all eight before each pay run and at the end of each quarter.

1
Set up your employees correctly from day one Critical

Getting the setup right at the start saves a lot of work later. Before you run your first pay for a new employee, make sure you have all of this in place.

  • Collect a completed Tax File Number declaration from the employee
  • Record their employment type - full-time, part-time or casual
  • Confirm their pay rate and whether a Modern Award applies to their role
  • Collect their super fund details - fund name, USI and member number
  • If the employee has not chosen a fund, check your obligations around stapled super funds via the ATO
  • Set up the employee in Xero Payroll with the correct tax and super settings before the first pay run
2
Process each pay run correctly

Every pay run needs to be processed accurately before payment is made. Rushing this step is where most payroll errors start.

  • Confirm hours worked for the period - including any overtime, leave taken or public holidays
  • Check the correct pay rate is applied, including any Award allowances or penalty rates
  • Verify PAYG withholding is calculated correctly based on the employee's tax file number declaration
  • Calculate superannuation at 12% of ordinary time earnings (changing to "qualifying earnings" from 1 July 2026)
  • Review the pay run summary before finalising - check gross pay, tax withheld and super match what you expect
  • Pay employees on or before the agreed pay day
3
Lodge Single Touch Payroll on every pay day Critical

Single Touch Payroll is mandatory for all employers in Australia. Every time you run a pay, the payroll information must be reported to the ATO on or before the payment date. Xero Payroll handles this automatically when you finalise a pay run - but you need to make sure it has actually been submitted, not just saved.

  • Confirm the STP submission status in Xero after each pay run
  • Check for any error notifications from the ATO - these need to be resolved promptly
  • At the end of the financial year, finalise your STP data in Xero so employees can access their income statements in myGov
  • The EOFY finalisation replaces the old payment summary process - do not issue paper payment summaries
4
Pay super correctly and on time Critical

Super is not just a payroll calculation - it is a payment obligation with two different sets of rules depending on when you are reading this.

Until 30 June 2026 - current quarterly rules:

  • Super must be paid by 28 October (Q1), 28 January (Q2), 28 April (Q3) and 28 July (Q4)
  • Payments must be received by the employee's nominated super fund by the deadline, not just sent
  • Use a SuperStream-compliant clearing house - Xero Payroll handles this - to pay multiple funds
  • The ATO Small Business Superannuation Clearing House closes 1 July 2026. If you currently use it, move to Xero Payroll or another alternative before then
  • Missing the quarterly deadline triggers the Super Guarantee Charge, which is not tax deductible

From 1 July 2026 - Payday Super:

  • Super must be paid on every payday, at the same time as wages
  • Contributions must be received by the employee's super fund within 7 business days of payday
  • The calculation basis changes from ordinary time earnings to "qualifying earnings" (QE), which is broader and includes salary sacrifice amounts
  • The Super Guarantee Charge applies per pay period under the new system, meaning late payments attract penalties more frequently
  • Xero Payroll is being updated to support Payday Super - make sure your Xero is up to date before 1 July 2026
  • If you miss a payment, voluntary disclosure to the ATO before they contact you results in a lower penalty
5
PAYG withholding obligations

PAYG withholding is the tax you deduct from employee wages and send to the ATO on their behalf. The amount is calculated using the ATO's tax withholding tables based on the employee's income and tax file number declaration. It is reported through STP and paid when you lodge your BAS or IAS.

  • Withhold the correct amount using the ATO's current tax withholding tables
  • If an employee has not provided a TFN, withhold at the top marginal rate (47%)
  • Report PAYG withholding through STP on each pay day
  • Pay the withheld amounts to the ATO when your BAS or IAS is due - monthly or quarterly depending on your withholding amount
  • Reconcile your PAYG withholding at year end against your STP data to make sure everything matches
6
Leave management and accruals Ongoing

Leave entitlements are a legal obligation, not optional. Getting these wrong is a common source of Fair Work complaints for small businesses.

  • Full-time and part-time employees accrue annual leave at 4 weeks per year under the National Employment Standards
  • Personal leave (sick and carer's leave) accrues at 10 days per year for full-time employees, pro-rated for part-time
  • Casuals do not accrue leave but are entitled to a casual loading - currently 25% under most Awards - instead
  • Track leave balances in Xero Payroll and reconcile them regularly
  • When an employee leaves, any accrued and unused annual leave must be paid out in the final pay
7
Modern Awards - know your obligations Overview

Modern Awards are legal documents set by the Fair Work Commission that specify minimum pay rates, penalty rates, allowances and conditions for employees in specific industries and occupations. Most small business employees are covered by a Modern Award.

If an Award applies to your employees, you must pay at least the Award minimum rates - paying less, even if the employee agrees to it, is wage theft under Australian law. Awards are updated regularly, including an annual minimum wage review each July.

  • Identify which Award or Awards cover your employees using the Fair Work Award Finder at fairwork.gov.au
  • Check the minimum pay rates for each classification in the Award
  • Check whether penalty rates, overtime or allowances apply to your employees' work patterns
  • Review your pay rates each July when the Fair Work Commission updates the national minimum wage and Award rates

For specific Award advice, visit fairwork.gov.au or contact the Fair Work Infoline on 13 13 94.

8
Termination and final pay When required

When an employee leaves - whether they resign, are made redundant, or are dismissed - their final pay has specific requirements. Getting this wrong can result in a Fair Work complaint or an ATO issue.

  • Pay all outstanding wages for hours worked up to the last day
  • Pay out any accrued and unused annual leave at the employee's ordinary pay rate
  • Check whether long service leave applies based on the employee's length of service and your state
  • Calculate any redundancy pay if applicable under the National Employment Standards or the relevant Award
  • Withhold the correct amount of tax on termination payments - different rules apply to different components
  • Process the termination in Xero Payroll and report it through STP
  • Super is still payable on the final pay - check which components qualify as ordinary time earnings (or qualifying earnings from 1 July 2026) and which do not

Watch Out For

Common Payroll Mistakes That Lead to Penalties

These are the most common issues the ATO and Fair Work see from small businesses.

Paying super late

The SGC is not tax deductible, so late payments cost more than paying on time. From 1 July 2026 under Payday Super, the charge applies per pay period - the exposure increases significantly.

Not checking Award rates after July

The Fair Work Commission updates minimum rates every July. If you set a pay rate and never revisit it, you may be underpaying employees without realising - and that is a Fair Work breach.

Treating employees as contractors

Classification depends on the actual working arrangement, not just the contract. Misclassifying to avoid payroll obligations is something the ATO actively pursues. Ask us if you are unsure.

Not finalising STP at year end

Until you finalise STP in Xero Payroll, your employees cannot access their income statements in myGov. The deadline is 14 July each year.

Forgetting super on termination pay

Super is payable on ordinary time earnings in the final pay, but not on all termination components. Getting this wrong in either direction creates a problem - use Xero Payroll to calculate it correctly.

Not keeping payroll records

The ATO and Fair Work require payroll records for seven years. Xero Payroll stores most of this automatically - just make sure your account is backed up.

FAQ

Frequently Asked Questions

What is the current superannuation rate in Australia?
The super guarantee rate is 12% from 1 July 2025. Currently super is paid quarterly, with the deadline being 28 days after the end of each quarter. From 1 July 2026, Payday Super legislation requires super to be paid on every payday and received by the employee's fund within 7 business days. This is a major change - if you are not already using Xero Payroll, now is the time to get set up before the transition. Get in touch if you need help.
Do I need to pay super for casual employees?
Yes. Since 1 July 2022, the $450 per month earnings threshold was removed. All employees, including casuals, are now entitled to super regardless of how much they earn in a month. The only exceptions are employees under 18 who work 30 hours or less per week, and some private or domestic workers.
What is Single Touch Payroll and do I have to use it?
Single Touch Payroll is a mandatory ATO reporting system that requires employers to report payroll information - wages, PAYG withholding and super - to the ATO on or before each pay day. All employers in Australia must use STP regardless of how many employees they have. Xero Payroll submits STP automatically when you finalise each pay run.
How much does payroll processing cost with AffordBooksTax?
Payroll is $14 per employee per pay period, regardless of whether you pay weekly, fortnightly or monthly. This includes processing, STP lodgement and emailing payslips to employees. There is no setup fee and no lock-in contract. See our full pricing page for details.
What happens if I underpay an employee?
Underpaying an employee - even unintentionally - is a breach of the Fair Work Act. You are required to back-pay the employee for any shortfall. Deliberate underpayment can result in significant penalties for both the business and its directors. Fair Work can investigate complaints and conduct audits. If you think you may have underpaid someone, address it proactively rather than waiting.
Do I need to use Xero for payroll?
AffordBooksTax uses Xero Payroll to process payroll for all clients. Xero handles STP lodgement, leave accruals, super calculations and payslip distribution automatically, which reduces errors and keeps everything in one place. If you are not already on Xero, we can help you get set up. See our Xero setup service for details.
What is Payday Super and how does it affect my business?
Payday Super is legislation passed in November 2025 that changes when employers must pay super. From 1 July 2026, instead of paying super quarterly, you must pay it on every payday and it must be received by the employee's fund within 7 business days. The Super Guarantee Charge will apply per pay period rather than per quarter, increasing the cost of late payments. The ATO Small Business Clearing House also closes on 1 July 2026 - if you use it, you need to move to an alternative before then. Xero Payroll is being updated to support Payday Super and is what AffordBooksTax uses for all clients.
